Rosalyn Maldonado is a litigator with over 20 years of experience defending actions arising out of labor and employment, real estate, breach of contract, construction and personal injury claims. Ms. Maldonado’s skills as a litigator are enhanced by her experience as a transactional attorney who has drafted shareholder and employment contracts, purchase and sale agreements as well as merger and acquisition transaction contracts.

Ms. Maldonado began her legal career in 1995 at the Red Apple Group one of the largest privately owned corporations in the United States, with annual revenues in excess of $4 billion dollars. She rose steadily in the legal department and was ultimately promoted to the position of Deputy General Counsel where she was responsible for supervising, mentoring and training junior level attorneys. Her responsibilities at the Red Apple Group encompassed both transactional and litigation matters and required her to provide counsel to all domestic and foreign business units and corporate affiliates regarding labor, employment, real estate and litigation matters. She was responsible for handling employee claims, including but not limited to, arbitration matters and termination of union and non-union employees. Ms. Maldonado defended employment discrimination lawsuits at the administrative level and in federal and state courts and helped defend two FLSA class action lawsuits in the Southern District of New York. In addition she was called upon to draft leases and other agreements and litigate residential and commercial landlord-tenant disputes in the civil and state courts of New York. She was also required to supervise the handling of personal injury premises liability claims.

In 2005, Ms. Maldonado joined the law firm of French & Casey, LLP, in New York City. Ms. Maldonado continued to sharpen her litigation skills in both federal and state courts defending and prosecuting actions arising out of employment matters, commercial real estate claims, labor disputes, and construction actions. Her responsibilities included drafting pleadings, handling discovery, conducting and defending depositions, briefing and arguing dispositive motions, participating in administrative hearings, mediations, and trials and negotiating and drafting settlement agreements. Her transactional work at this firm required her to counsel crane companies regarding new OSHA and NYC Building Department regulations, scaffolding companies regarding mechanic’s lien laws and NYC Building and Transportation Department regulations and general contractors regarding AIA contracts and indemnification provisions. She was additionally responsible for drafting corporate formation documents, shareholder and employment contracts, purchase and sale agreements and commercial and residential lease agreements.

In 2013, Ms. Maldonado joined the firm of Moritt Hock & Hamroff LLP where she was responsible for representing physicians, financial institutions, vehicle leasing companies and private individuals in all phases of litigation. She drafted pre and post answer dispositive motions and assisted in the defense of a construction company before the National Labor Relations Board. Ms. Maldonado left the firm in 2014 to establish her own practice and is "of counsel" to Rush & Sabbatino, PLLC.

Ms. Maldonado received her B.A. in Sociology, cum laude, from Brandeis University in 1990. She was on the Dean’s List at Brandeis and graduated with Highest Honors in Sociology. She received her J.D. from Fordham University School of Law in 1993. During her time at Fordham, Ms. Maldonado was named President of the Latin American Law Students Association (LALSA) and participated in the Wormser Moot Court Competition as well as the National LALSA Moot Court Competition.

Ms. Maldonado is admitted to practice law in the State of New York as well as in the United States District Courts for the Southern and Eastern Districts of New York. She is a member of the New York State Bar Association, The National Hispanic Bar Association, The Defense Research Institute, the New York City Women’s Bar Association, the Fordham Law School Alumni Association, the Brandeis University Alumni Association and Cafecito, New York City Association of Latina Attorneys.
